NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OF STERLING PRODUCTS WILL NOT INCREASE YOUR CHANCES OF WINNING. ODDS OF WINNING WILL DEPEND ON THE TOTAL NUMBER OF ELIGIBLE ENTRIES RECEIVED. VOID WHERE PROHIBITED BY LAW. ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND PARTICIPANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.
INTRODUCTION
By entering the Sterling-sponsored Sweepstakes (each, a “Giveaway”), an individual entering the Giveaway on behalf of/representing their employer (“Participant”) and the employer (“Company”) agrees to abide by these Official Rules and Legal Disclaimers, and the decisions of Sterling Computers Corporation (“Sterling”), such decisions which are final and binding in all respects.
ELIGIBILITY:
The Giveaway is open solely to individuals present at the TAGITM Conference who are legal residents of the fifty (50) United States and the District of Columbia (the “Eligible Territory”) who are who are eighteen (18) years of age (except in the case of residents of jurisdictions where the legal age of majority is greater than eighteen (18) years, such legal age of majority) or older at the time of entry. Employees, officers, directors, or agents of Sterling (“Sponsor”) or any of Sponsor’s partners, related companies, agencies, or agents, as well as the immediate family (defined as spouse, parents, siblings, children, and grandparents) and same household members of any such employee, officer, director, or agent, are not eligible to participate or win a prize. This Giveaway is subject to all applicable laws, rules, and regulations. Void outside the Eligible Territory and where prohibited or restricted by law, rule, or regulation. Participants do not have to complete the Sterling Survey to be eligible for the Giveaway.
HOW TO ENTER:
The Giveaway entry period begins at the beginning of the TAGITM Conference 12:30 p.m. Central Time (“CT”) on April 3, 2024 and ends at 12:30 p.m. CT on April 4, 2024. (“Entry Period”). A Participant may enter the Giveaway through one (1) method of entry, in person by returning the registration card during the Entry Period. No other method of entry will be accepted. Limit one (1) entry per Participant and one (1) entry per Company.
Method of Entry: To enter, a Participant must complete a survey registration card with the Participant’s first and last name, email address, telephone number, and employer (“Company”). The survey registration card must be completed in-person at the Sterling booth located at the TAGITM conference event. Upon successful completion of a survey registration card, the Participant is entered in the Giveaway. Completion of the survey is not a requirement for eligibility.
No other method of entry will be accepted. Sponsor will not consider incorrect, fraudulent, incomplete, late, or otherwise non-conforming entries or entries that are intended to annoy, abuse, threaten, or harass any person or entity in any way. Limit of one (1) entry per Participant and Company; multiple entries by any one Participant are void. If multiple registration cards are received for a Company, only one will be entered into the Giveaway. Entries generated by macro, script, or other automated means are void. Any Participant using fraudulent means to participate in a Giveaway will be disqualified and may be guilty of violating applicable criminal laws. All entries, once provided, are Sponsor’s sole and exclusive property. Eligibility is at the exclusive discretion of Sponsor, and Sponsor shall be entitled to reject any entry for any reason or no reason at all without having to provide an explanation. Sponsor reserves the right, in its sole discretion, to cancel, suspend, or terminate a Giveaway for any reason and without prior notice to any Participant. In such instance, Sponsor may, if and as appropriate, select a winner using reasonable means that are materially consistent with the Official Rules contained herein.
Survey Parameters: Each survey registration card includes the opportunity for Company to potentially utilize a free Sterling Survey. Each Sterling Survey is a thirty (30) minute Discovery Teams Meeting. Each survey registration card allows a Participant to select one (1) of the three (3) types of a free Sterling Survey. A Participant may choose from a (1) Next-Gen Wireless Survey; (2) Cloud Readiness Survey; or (3) Data Center Modernization Survey. Participants do not have to complete the Sterling Survey in order to be eligible for the Giveaway.
(1) Next-Gen Wireless Survey. Sterling provides an in-depth analysis of the company’s needs for the next-gen wireless solution. After an initial discovery with the company to review the details of their building and end user needs, Sterling can create a predictive heat map utilizing various OEM AP models to meet the ever-growing demands of wireless connectivity.
(2) Cloud Readiness Survey. Sterling’s Cloud Assessment, led by expert architects, delves into an organization to evaluate security, infrastructure, and culture, aiming to optimize cloud strategy towards hybrid, public, or private models. It assesses alignment with IaaS, PaaS, and SaaS, ensuring the best cloud solution for an organization’s needs.
(3) Data Center Modernization Survey. Sterling’s Remote Data Center Assessment, led by the Pre-Sales Engineering team, evaluates infrastructure, security, and performance remotely. It analyzes hardware, software, and environmental controls, focusing on capacity, resilience, and cybersecurity through remote tools. The goal is to enhance reliability, mitigate risks, and support organizational objectives.
Each type of Sterling Survey will be conducted remotely by Sterling; the Sterling Survey is limited to one (1) Company environment; and the Sterling Survey is limited to (1) Company building.
THE DECISION BY COMPANY TO ENGAGE IN THE FREE STERLING SURVEY IS NOT REQUIRED FOR A VALID ENTRY INTO THE GIVEAWAY. THE DECISION BY COMPANY TO UTILIZE THE FREE STERLING SURVEY IS DOES NOT IMPACT THE ODDS OR OUTCOME OF THIS GIVEAWAY.
RANDOM DRAWING; ODDS; NOTIFICATION
On [April 9, 2024] (“Drawing Date”), one (1) potential winner will be selected by random drawing at Sterling Computers Corporation, 303 Centennial Drive, North Sioux City, SD 57049 from among all eligible entries received within the Entry Period. Subject to verification of eligibility and compliance with these Official Rules, the potential winner will be declared the official winner of the Giveaway. Odds of winning depend on the total number of eligible entries received.
The potential winner will be notified at the email address and/or telephone number (as determined by Sponsor) provided at the time of entry by April 9, 2024 (the “Prize Notification”). In the event that any potential winner does not respond to Prize Notification within five (5) day of the date of issuance or declines the prize for any reason, a disqualification will result, the prize will be forfeited and, at Sponsor’s sole discretion and time permitting, an alternate potential winner may be randomly selected from among all remaining eligible entries.
PRIZE; PRIZE CONDITIONS
One (1) Prize will be awarded to the Company listed on the registration card that is drawn. The winning Company will receive a free Windows11 Readiness Assessment, with an approximate retail value of $7,500.
The free Windows11 Readiness Assessment includes: The Windows 11 & Modern Management Pilot Program is designed to help companies embrace the latest advancements in technology and elevate your productivity. Currently, the End of Life for Windows 10 operating system is scheduled for October 14, 2025. With the comprehensive suite of services, we will provide you with a services engagement allowing a seamless transition to Windows 11. This will empower your workforce with enhanced features and capabilities.
Any potential winner will forfeit the Prize if the Participant: (1) fails to respond in a timely fashion to any of Sponsor’s requests for information or signatures with respect the Giveaway or the Prize; (2) cannot be reached at the information provided by such individual; (3) rejects the Prize (or it is returned undeliverable through no fault of Sponsor); or (4) is disqualified from the Giveaway for any reason. In the event of any forfeiture hereunder, an alternate winner will be selected. Prize winners are solely responsible for all applicable: (1) federal, state, and local taxes; and (2) out-of-pocket expenses, associated with Prize acceptance and use. A Prize will not be substituted by Sponsor for cash or other merchandise pursuant to any Prize winner’s request. Sponsor, however, reserves the right to substitute alternate Prizes of comparable or equal value in its sole discretion. Subject to applicable law, Prizes are offered “as is” without any express or implied warranty of any kind or nature, including without limitation, any warranty respecting condition, merchantability, quality, title, or fitness for a particular purpose. Sponsor is not responsible for replacing any damaged Prizes unless such damage is caused by Sponsor. Winners must look to the Prize’s manufacturer for potential guarantees or warranties of any kind.
RELEASE
Subject to applicable law, by entering into a Giveaway and potentially receiving a Prize, each Participant and Company agrees to release, discharge, and hold harmless Sponsor, along with Sponsor’s employees, officers, directors, affiliates, partners, agents and assigns, from and against any claim, cause of action, demand, or proceeding (each, a “Claim”), and any resultant loss, injury (including death), cost, expense, fee, fine, penalty, or other loss or expense of any kind, including attorneys’ fees (each, a “Loss”), relating to or arising directly or indirectly out of participation in a Giveaway (or related activity such as a press release), and/or Sponsor’s right to use Company’s name or fully exploit any other right granted to it hereunder, and/or from Participant or Company’s receipt, use, or misuse of any Prize, no matter how such Claim or Loss arises (including without limitation, if arising out of any damage to a Participant or Company’s computer system from downloading or using material from Sponsor’s (or an affiliate Of Sponsor’s) website).
LIMITATION OF LIABILITY
IN NO EVENT WILL SPONSOR, AND/OR SPONSOR’S PARENT, SUBSIDIARY, LICENSEES, EMPLOYEES, AGENTS, OFFICERS, DIRECTORS, ASSIGNS, AFFILIATES, OR RELATED COMPANIES (COLLECTIVELY WITH SPONSOR, THE “SPONSOR’S PARTIES”), BE RESPONSIBLE OR LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTAL, OR PUNITIVE DAMAGES (INCLUDING WITHOUT LIMITATION LOST PROFITS) ARISING OUT OF ANY PARTICIPANT’S PARTICIPATION IN THE GIVEAWAY, THESE OFFICIAL GIVEAWAY RULES, AND/OR ANY PARTICIPANT OR COMPANY’S RECEIPT OF A PRIZE, NO MATTER UNDER WHAT THEORY ARISING, EVEN IF ANY SPONSOR PARTY HAS BEEN ADVISED OF THE POSSIBLY OF SUCH DAMAGES. SPONSOR PARTIES’ ENTIRE LIABILITY WITH RESPECT TO: ANY PARTICIPANT’S PARTICIPATION IN THE GIVEAWAY, THESE OFFICIAL GIVEAWAY RULES, AND/OR ANY PARTICIPANT or COMPANY’S RECEIPT OF A PRIZE SHALL BE LIMITED TO $500. SOME JURISDICTIONS MAY NOT ALLOW THE AFOREMENTIONED LIMITATIONS OR EXCLUSIONS OF LIABILITY AND AS SUCH, THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
USE OF COLLECTED MATERIALS AND INFORMATION
By entering into any of Sponsor’s Giveaways, Participants agree to Sponsor’s collection and use of their personal information. DISPUTE RESOLUTION
The parties hereto acknowledge and agree as follows: (1) that all disputes, causes of action, and claims connected to or arising in any way hereunder between the parties shall be resolved solely on an individual basis (i.e., class actions suits are hereby waived by the parties), and exclusively by the state or federal courts situated in UNION COUNTY, SOUTH DAKOTA; (2) that the laws of the state of South Dakota shall govern, without regard to its conflict of laws principles; and (3) that the parties hereto waive any right to a trial by jury.
